Fire and Re-Hire Update

Following my recent Fire and Re-Hire post, Tesco have fallen foul of the law.

They wanted to end the contracts of people on a ‘retained pay’ agreement and offer them new
contracts without this benefit – a basic ‘fire and re-hire’ situation.

The Supreme Court has decided that they could not fire people simply to prevent people from having this right. We can no longer assume that firing people to change their terms will be acceptable.

Changing an employee’s terms of employment is now much more complicated.
